Who we are

PowerPod is operated by Talkc Ai Pvt. Ltd., a company registered in Nepal (PAN 624710701), Kathmandu. “We” means Talkc Ai Pvt. Ltd. These terms apply when you create an account or use the service, through the website or the API.

The service

We rent you computing time on GPU servers. The servers are operated by independent hosting partners around the world; we arrange, price and bill the rental and run the software that sets up your instance.

Each server’s measured reliability is shown before you rent. We do not guarantee uptime: a server can go offline, and if it does we stop billing you for it.

Your account

Give us accurate details and keep your password and API keys private. You are responsible for everything done with your account and keys.

We check every payment, including the name on the account it came from, before adding the credits. We may ask for a photo ID and a selfie before further rentals if a payment does not match, someone reports misuse, or the law requires it. You must be at least 18, or have the permission of a parent or guardian.

Credits and billing

The service is prepaid. You add credits, and the price of a server is shown before you rent it and locked for that instance.

GPU time is billed by the second while an instance runs. Disk storage is billed while the instance exists, including while it is stopped. Network transfer is billed per GB at the rate shown before you rent. One hour of credit is held in reserve while an instance runs and released when it stops.

When your credit runs low we warn you, and below five minutes of remaining credit we stop your instances. A stopped instance with no credit is kept for seven days and then deleted, with reminders before that happens.

Top-ups are credited once the payment has been checked. Statements are issued monthly.

Acceptable use

You must follow the acceptable-use policy. If you break it we may suspend or close your account, stop your instances, and keep back from a refund the costs your breach caused us.

Your data

What you put on an instance is yours. We do not access the contents of your instances. You are responsible for keeping copies of anything important: an instance that is destroyed, or whose server fails, cannot be recovered. Optional backups are available in the console.

How we handle your personal information is described in the privacy policy.

Liability

The service is provided as it is, on hardware we do not own. To the extent the law allows, we are not liable for lost data, lost profits or indirect losses, and our total liability to you is limited to what you paid us in the three months before the claim.

Closing your account

You can close your account at any time. Unused credits are handled under the refund policy. We may suspend or close an account for a breach of these terms, for fraud, or where the law requires it.

Changes

We may update these terms. We will tell you about material changes by email or in the console. If the acceptable-use policy changes, you will be asked to accept the new version before your next rental.

Law

These terms are governed by the laws of Nepal, and the courts of Kathmandu have jurisdiction.
